IS CBD LEGAL IN THE U.S. VIRGIN ISLANDS?

Let’s start off with the good news: CBD is fully legal in the U.S. Virgin Islands.

In fact, CBD is even more legal here than it is in the mainland U.S. The difference? Around here CBD is legal pretty much regardless of its source — even if it was derived from high-THC cannabis.

It all began in 2016 when a law called Bill 31-0330 stated that any federal laws regarding industrial hemp be automatically adopted by the Virgin Islands. Basically, Island lawmakers decided to defer to the Continental U.S.’s judgment.

And in this case, that judgment was good! It would only be 2 years until the most hemp-friendly Farm Bill ever was passed. In 2018, the cultivation and sale of industrial hemp became legal across the U.S. Virgin Islands.

HEMP FARMING IN THE U.S. VIRGIN ISLANDS

Hemp farming is soon coming to an Island near you!

Seriously. The USDA (United States Department of Agriculture) recently announced big plans for hemp cultivation among the following locals and tribes:

  • U.S. Virgin Islands
  • Cheyenne River Sioux Tribe
  • Chippewa Cree Tribe
  • Lac Courte Oreilles Band of Lake Superior Chippewa Indians
  • Red Lake Band of Chippewa Indians

All told, the USDA approved 47 different demographics for these new hemp-friendly plans. In addition to providing farmers with much-needed guidance, they provide federally-backed loans, soil testing programs, and more.

“This is very welcomed news for the territory,” The Honorable Governor Albert Bryan Jr. told St. John’s Source. “Not only will this approval lead to the potential for an increase in our local export manufacturing, but it will also help us further diversify our economy and add new streams of revenue.”

These developments are still in the making, so be sure to stay tuned! Island hemp farmers may very well have plants in the ground by next spring.

WHAT ABOUT CANNABIS LEGALITY?

Medical Cannabis is legal on the Islands, too, per 2019’s Medicinal Cannabis Patient Care Act. Also known as Act 8167, this legislation came into being when over 56% of Island residents voted in favor of medical cannabis.

How its regulations will be enacted remains to be seen…in the meantime, even recreational cannabis has been decriminalized. But why take a risk when you can opt for equally beneficial CBD?

TRAVELING WITH CBD?

In other good news, those traveling back and forth from the Virgin Islands to the Continental US also have nothing to fear. While the TSA was once less than friendly towards CBD, times have changed, and today CBD-toting travelers can come and go freely.

Want to be extra safe? Make sure your CBD product of choice has nutrition info on its label; and, if it doesn’t, consider carrying along a copy of your product’s lab test.
